What does Member of the Royal Institution of Chartered Surveyors mean?

What is a Chartered Surveyor?

A Chartered Surveyor is member of the Royal Institution of Chartered Surveyors (RICS) which is an accepted / respected and worldwide acting professional institution of real estate experts. The Royal Institution of Chartered Surveyors (RICS) was established in London in 1868 and got the Royal charter in 1881. Only Chartered Surveyors are allowed to use the job title "MRICS" (Professional Member of the Royal Institution of Chartered Surveyors) or "FRICS" (Fellow of the Royal Institution of Chartered Surveyors). Both job titles are the seal of quality for professionalism and integrity. Chartered Surveyors have to follow the rigid rules of conduct ("Code of Ethics") in order to fulfil the interests of the clients and the public. It is difficult to translate the perception "Chartered Surveyor". Hence these words stand worldwide for highly skilled real estate experts.

What does a Chartered Surveyor do??

Chartered Surveyors have a comprehensive knowledge with regard to real estate, property and constrution projects. They understand the real estate business and also the subject-based legislation, the essential service sectors as well as the efficiency of construction, purchase, administration, management, evaluation and the sale of real estate.


What does the official appointment and swearing-in mean?

appraiser - independent and impartial

The title "appraiser" is not legally protected in Germany. The consequence is that inadequately qualified appraisers call themselves appraiser and act in this market. To distinguish between real experts and others who don't possess the required qualification the German legislation stipulates the official appointment.

The official appointment attests the appraiser a special qualification on a certain field of activity.

Moreover, offcially appointed and sworn appraisers are sworn to act independently and impartially. That means: third parties can rely on the (expert) opinions which are usually submitted to them. Such a neutral (expert) opinion strengthens at the same time the reputation and the position of the client. He does not arouse suspicion that he relies on a partial (expert) opinion. As they're independent and impartial offically appointed and sworn appraisers are preferentially instructed by law courts.

qualification - permanent on trial

Only experts with an outstanding qualification get / achieve the official appointment. To get / receive the official appointment they have to undergo an extensive test procedure. And afterwards their work is under permanent national control (In Hamburg the Chamber of Commerce is responsible for it.). That also means that already officially appointed and sworn appraisers can lose their status if their qualification does not meet the current requirements. Moreover, appointed appraisers are tested concerning reliability and personal integrity. Only then they are allowed to guide the coveted seal of quality.

Officially appointed appraisers do not only furnish (expert) opinions which ascertain the facts or deternine the reasons. They also discuss / deliberate and take the responsibility for regular tests and supervisions, they analyse and evaluate. And the two contracting parties can determine that they accept the professional judgement of the appraiser as obligatory. 

legislation - confidence and security

The assignment of officially appointed and sworn appraisers ensures certainty for entrepreneurial, legal and private decisions. Due to this fact the German lawmaker has introduced the official appointment. As the state accepts the special qualification of those appraisers and the special quality of their services, it is easier for companies, law courts and consumers to find a qualified appraiser whose (expert) opinions meet the high requirements.


What does certification mean?

There is neither a regulaton nor a law for the Sachverständigenwesen in Germany. Therefore consumers have to find independently an adequate appraiser. According to experience the certification is due to deficient information difficult.

From the point of view of the consumer the goal of the certification means comparability and certainty when they look for an appraiser. From the point of view of the appraiser the goals of a Europe-wide admission and the advantage in competition to not-certificated appraisers come to the ground.

The European Commission and the EFTA agreed on a program for the certification and accreditation of quality systems and manpower in 1989. Since then a consistent test system for the field of activity "Grundstücksbewertung" has been developed. The whole system is based upon the voluntariness of the participants / involved.

A certification according to the norm DIN EN ISO/IEC 17024 confirms, that the appraiser is competent on the special field of activity. Regular tests and recertification ensure that the certificate does not lose its value.
